Black Agenda Radio · Birthright Citizenship and the Supreme Court

On Inauguration Day, Donald Trump issued an Executive Order which stated that the federal government would require proof of parental citizenship or permanent residency in order to grant birthright citizenship. In the immediate aftermath of the Executive Order, injunctions were filed in federal courts, and three of these cases were consolidated and heard before the Supreme Court. In a 6 - 3 ruling the justices concluded that universal injunctions exceed the power of federal courts. Now lower courts must determine the proper scope of the injunction issue. We’re joined by two attorneys from the NAACP Legal Defense and Educational Fund, Morenike Fajana, and Ashley Burrell, who will provide analysis on the court decision and the implications for birthright citizenship. They are litigating a related case before the court and both of them join us from New York City.
